Consumer guarantees
Every purchase from Skyluxe Health comes with guarantees under the Australian Consumer Law. They cannot be excluded, limited or modified — not by us, and not by anything written in a policy page.
The statement, in the words the law uses
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
What that covers
Acceptable quality
Goods must be safe, lasting, free from defects, acceptable in appearance and finish, and do everything they are ordinarily expected to do. A device that stops emitting light, or arrives with a dead LED bank, is not of acceptable quality.
Match the description
Goods must match how they were described to you — on the product page, in the specification table, in an email, or by a person on the phone. If we state a wavelength, an LED count or a measured output, the device has to meet it.
Fit for the purpose you told us
If you tell us what you want to use a device for and we say it will do that, it has to. If we are not sure, we will say we are not sure.
Spare parts and repair
Where repair facilities and spare parts are reasonably expected, they must be available for a reasonable time after purchase. We hold parts in Australia.
Honour our warranty
Any express warranty we give — including the Skyluxe device warranty — is itself something we are legally required to honour.
Major failure versus minor failure
A failure is major when the problem is substantial — the device is unsafe, it is significantly different from what was described, it does not do what we said it would, or it cannot be fixed easily or within a reasonable time. When a failure is major, the choice of a refund or a replacement is yours, not ours.
When a failure is not major, we may choose to repair the device within a reasonable time. If we do not, you can have it fixed elsewhere and recover reasonable costs from us, or reject the device.
How this sits with our own terms
Our 30-day home trial and our [EDIT: warranty term] warranty are things we offer voluntarily. They sit on top of these guarantees, never in place of them.
You will not find the phrase “no refunds” anywhere on this site, on a sale item, or in a confirmation email, because it would be both wrong and unlawful. Consumer guarantees apply to discounted goods in exactly the same way they apply to full-price goods.
Time limits on our trial do not limit your consumer guarantee rights, which last for a reasonable period given the price and nature of the goods.
